Effective January 1, 2011, a complete overhaul of the Business Entity Act became law in Alabama. The changes are primarily procedural in nature as much of the substance of the prior Act will remain unchanged. 

Frequently, a family believes their property is free of title problems because it has been in the family for generations. However, title to property inherited from a deceased family member may not always be clear and is often clouded by a number of unaddressed problems. 

These problems will often surface only when one attempts to sell the property.  Therefore, the heirs should seek a legal opinion.

The Veterans Administration offers a largely unknown Improved Pension benefit to offset the cost of necessary health care.  This Improved Pension is available for veterans and surviving spouses who require the regular attendance of another person to assist in eating, bathing, dressing, attending to the wants of nature, or protecting himself/herself from the hazards of his/her daily environment.  Also, individuals who are blind, a patient in a nursing home, or a resident of an assisted living facility may be entitled to this benefit. 

Congress alleviated the uncertainty surrounding the federal estate tax by fixing the federal estate tax exemption at $5,000,000.00 (at least for the next two years) with a top tax rate of 35%.  The estate tax exemption was set to revert to $1,000,000.00 at the beginning of 2011.  At that level, the federal estate tax would have impacted a fair percentage of the population.  However, the $5,000,000.00 exemption far exceeds the value of the average estate.  It might seem that, for the near future, the federal estate tax is no longer a consideration in estate planning for t
